Environmental impact assessment and post-project monitoring (ATS)

18 December 2017 year entered into force Law of Ukraine "On environmental impact assessment", introducing a new permit document - conclusion of the environmental impact assessment (ATS) thereby canceling the environmental examination.

The OVD procedure is aimed at preventing and preventing damage to the environment, ensuring environmental safety, environmental protection, rational use and reproduction of natural resources, in the process of making decisions about conducting business activities, which can have a significant impact on the environment, taking into account the state, public and private interests.

The assessment of the impact on the environment is carried out in compliance with the requirements of the legislation on environmental protection, taking into account the state of the environment in the place, where it is planned to carry out the planned activity, environmental risks and forecasts, prospects of socio-economic development of the region, capacity and types of cumulative impact (direct and indirect) on the environment, including taking into account the impact of existing facilities, planned activity.

Without assessing the impact on the environment and obtaining a decision on the implementation of the planned activity it is prohibited to carry out the planned economic activity, operation of objects, intervention in the natural environment and landscapes. article 3 p. 4 Law of Ukraine "On Environmental Impact Assessment".

The environmental impact assessment procedure consists of the following stages:

  • Determining the category of the type of activity and preparing a notification about the planned activity, subject to an environmental impact assessment;
  • Registration of a notice of planned activity in The unified register with the OVD and publication in the mass media of a notice about planned activities, subject to an environmental impact assessment (2-x newspapers);
  • Preparation of an environmental impact assessment report in accordance with legislation;
  • Submission of the report and announcement of the start of public discussion to the Unified Register of ATS and publication in the mass media of the announcement of the start of public discussion of the ATS report (2-x newspapers);
  • Support during public hearings;
  • Obtaining a conclusion from the Ministry of Internal Affairs and publication in the mass media about the conclusion and decision on the implementation of the planned activity (in 2 newspapers).
  • Post-project monitoring.

POST-PROJECT MONITORING (ATS)

Post-project environmental monitoring – a complex system of observations, assessment and forecast of changes in the state of the environment under the influence of anthropogenic factors, monitoring is an information system of observations with a determined optimal number of parameters for assessing and forecasting changes in the state of the natural environment.

The requirements for post-project monitoring are fixed in Art. 13. "Post-project monitoring" of the Law of UkraineAbout environmental impact assessment», in which it is indicated that the business entity, if it is provided for by the conclusion of the environmental impact assessment, ensures the implementation of post-project monitoring in order to identify any discrepancies and deviations in the predicted levels of impact and effectiveness of measures to prevent environmental pollution and reduce it.

Post-project monitoring of planned activities is a component of the environmental impact assessment conclusion and required to be performed by the business entity. If the need for post-project monitoring is indicated in the conclusion of the ATS, the business entity undertakes to conduct it in the strictly specified manner and within the specified time.


The negative consequences of post-project monitoring or its non-performance may be as follows:

  • annulment of OTD results and appointment of re-passing of OTD procedure;
  • temporary stop or prohibition of planned activities at the enterprise.

Stages of work:

  1. Preparation of the post-project monitoring program (taking into account the requirements of the conclusion on the assessment of the impact on the environment of the corresponding planned activity), development of a plan and schedule of post-project monitoring taking into account the specifics of the planned activity or object and its coordination with the authorized body;
  2. Carrying out monitoring studies and developing a post-project monitoring report.
  3. Submission of the Report to the authorized body.
