Development of documentation and obtaining a permit for special water use
In order to carry out activities in the field of water use, each entity must obtain an appropriate permit, which is issued by the State Water Resources Agency of Ukraine and its territorial units. Obtaining a permit is mandatory for those entities, which use water in the volume of five cubic meters per day.
Obtaining a permit for special water use is mandatory for those subjects, which take water from water bodies using structures or technical devices, water use and discharge of pollutants into water bodies, including water intake and discharge of pollutants with return waters using canals (article 48 Water Code of Ukraine).
Special water use is carried out by legal entities and individuals primarily to meet the drinking needs of the population, as well as for economic and household purposes, medical, health care, agricultural, industrial, transport, energy, fisheries and other state and public needs.
Obtaining a permit is carried out in accordance with the following normative documents:

Development of individual balance norms for water consumption and drainage

The legal and organizational basis for establishing current individual balance norms for water consumption and drainage are regulated by the following documents:
- Law of Ukraine "On Environmental Protection";
- Water Code of Ukraine (article 40).
- Methodical guidelines for the development of norms and standards for water consumption and drainage, taking into account the quality of water, which is consumed and discharged in industry ( developed by the Scientific Research Institute of Planning and Standards of the State Planning of the USSR and recommended for the development of sectoral methods for regulating water consumption and drainage in industry. Letter from the USSR State Plan dated 18.07.79 No. VI - 1381-94-143 );
- Methodical manual for calculating current individual balance norms of water consumption and drainage ( NGO "Tor", 1987 p.).
Norms of water consumption and drainage are intended for:
- determining the limit of water consumption and drainage at the enterprise, which can be used to sign a contract with the water utility;
- establishing the need for wastewater treatment, that are diverted from production;
- control over the rational use of water, that is consumed.
Conducting work on the development of current individual balance sheet norms includes the following stages:
– examination of the industrial premises of the enterprise;
– collection of initial data about the enterprise, production technologies, stages of technological processes, technological equipment;
– determination of operating modes of water-consuming equipment and technological processes;
– calculation of individual balance norms of water consumption and drainage per unit of production.
The developed norms are established for the enterprise and are subject to revision or correction in the following cases:
– change in production conditions;
– replacement of water-consuming equipment;
– introduction of new technologies and installations;
– change in water quality, that is consumed and discharged.
Development of current individual technological standards for the use of drinking water and their approval and approval in accordance with current legislation
Enterprises, which provide centralized water supply services (production, transportation and supply of drinking water to consumers) and/or centralized drainage (removal and/or treatment of municipal and other wastewater) should be developed in accordance with the requirements of current legislation current individual technological standards for the use of drinking water (further - ITNVPV).
Current ITNVPV are used for:
- planning and organization of control over water management activities
- determination of the scope of implementation of centralized water supply and drainage services to determine their cost price and tariffs for these services
- determination of normative volumes of drinking water use by the enterprise
- determination of additional volumes of drinking water and wastewater, which enter the water drainage system in excess of the volume of implementation of centralized water drainage services
- justification of the need for water for obtaining permits for special water use
The procedure for developing and approving technological standards for the use of drinking water by enterprises, which provide centralized water supply and/or drainage services approved by order of the Ministry of Regional Development, of construction and housing and communal services of Ukraine from 25.06.2014 № 179 Registered in the Ministry of Justice of Ukraine 3 September 2014 p. for no 1062/25839
ITNVPV are established for:
- loss of drinking water;
- technological costs of drinking water in water supply systems;
- technological costs of drinking water in drainage systems.

Development of standards for the maximum allowable discharge of pollutants into water bodies
The discharge of return water into water bodies is one of the types of special water use and is carried out on the basis of permits, which are issued in accordance with the established procedure by the State Water Resources Agency of Ukraine and its territorial subdivisions (Art. 44, 48, 49 Water Code of Ukraine).
In the absence of a permit for special water use, officials of the water user, in accordance with Art. 110, 111 Water Code of Ukraine, Art. 46 Law of Ukraine "On drinking water and drinking water supply", Art. 68, 70 of the Law of Ukraine on Environmental Protection and Art. 1166 Civil Code of Ukraine, and also Art. 48, 60 Code on Administrative Offenses and p. 242, 243 The Criminal Code of Ukraine carries a disciplinary charge, administrative, civil - legal or criminal liability.
The discharge of wastewater into water bodies is allowed only if there are standards for maximum permissible concentrations and established standards for the maximum permissible discharge of pollutants (GDS) (Article 70 of the Water Code of Ukraine).
Norms of maximum permissible discharge (GDS) of pollutants are established with the aim of gradually achieving the ecological standard of water quality of water bodies (Article 38 of the Water Code of Ukraine).
The procedure for developing and approving standards for maximum permissible discharge and the list of pollutants, that are normalized, are established in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 11 September 1996. No. 1100 "On the Procedure for the development and approval of standards for the maximum permissible discharge of pollutants and the list of pollutants, the reset of which is normalized".
Legal and organizational principles of establishment, revision and clarification of GDS of substances with waste water of enterprises, organizations and institutions into surface water bodies are regulated by the following documents:
– The Law of Ukraine on environmental protection (Art. 33);
– Water Code of Ukraine (Art. 38, 70, 74);
– The Law of Ukraine on Animal World;
– Resolution of the Cabinet of Ministers of Ukraine dated 11.09.1996 No. 1100 "On the Procedure for the development and approval of maximum permissible discharges of pollutants and the list of pollutants, the reset of which is normalized";
– Methodological recommendations for the development of standards for the maximum permissible discharge of pollutants into water bodies with return waters. Order of the Ministry of Environmental Protection and Natural Resources of Ukraine from 5.03.2021 № 173;
– Order of the Ministry of Health No. 173 dated 19.06.96 "On the approval of the State Sanitary Rules for the Planning and Development of Settlements" as amended № 952 from 18.05.2018;
– Resolution of the Cabinet of Ministers of Ukraine dated 22.05.1996 № 552 "On the list of industrial plots of fishery water bodies (their parts)»;
– KND 211.1.1.106-2003 "Protection of the natural environment and rational use of natural resources. Organization and monitoring of surface water pollution (in the Ministry of Energy and Resources system)»;
– KND 211.1.2.008-94 "Metrological support. Hydrosphere. Rules for controlling the composition and properties of wastewater and process waters".
The obligations of water users to comply with the established regulations of the GDS of polluting substances and pollutant discharge limits are established by the article 44 Water Code of Ukraine.
The development and substantiation of the HDS standards of pollutants is carried out in the following sequence:
Stage 1. Acquaintance with the water management situation, obtaining raw data
Stage 2. Legal and methodical substantiation of the scheme and model for calculating the HDS norms of pollutants
Stage 3. Determination of calculation conditions and calculation of HDS standards of pollutants
Stage 4. Development of a plan of measures to achieve (compliance) regulations of the HDS of polluting substances
The norms of the water supply system are established simultaneously with obtaining a permit for special water use.

Development of water management passport
The enterprise's water management passport is developed in accordance with the requirements of the "Rules for the acceptance of waste water from enterprises into communal and departmental sewage systems of populated areas of Ukraine", approved by the Order of the State Building of Ukraine 19.02.2002 p. for #37, registered in the Ministry of Justice of Ukraine 26.04.2002 p. for №403/6691, in accordance with the Law of Ukraine "On Environmental Protection", Water Code of Ukraine, "Rules for the protection of surface water from pollution by return water", approved by the resolution of the Cabinet of Ministers of Ukraine dated 25 March 1999 year #465, according to the DBN. IN. 2.5-75:2013 "Sewerage. External networks and facilities".
The passport contains information about the enterprise's water supply and drainage systems. with a description of their technical parameters and the actual state at the time of drawing up the passport.
The Passport includes:
1) Characteristics of the enterprise's water supply and drainage systems, u t. h. :
- Calculation of the enterprise's needs for water of various categories on the basis of approved departmental norms of water consumption for the production of products.
- Calculation of the amount and formation of wastewater by category (industrial, household, rainy, etc. d);
- Characteristics of waste water quality, that are discharged into the city's sewage system;
- Characteristics of departmental water supply and sewage facilities: pumping stations, local treatment facilities, etc.;
- Quality indicators set by the owner of the city sewer (GDK) of wastewater to Enterprises when discharged into the city sewer system;
2) Graphic material:
- Scheme of the water supply and drainage network of the enterprise;
- Balance scheme of water supply and drainage;
3) The perspective of the development of water supply and drainage of enterprises and the plan of measures for the conservation of water resources and the reliable operation of the water supply and drainage systems of the enterprise.
The passport is valid for the duration of the Agreement on water supply and drainage of the enterprise with KP. When installing a new one (or lengthening the previous one) The passport of the contract for water supply and drainage is adjusted according to the actual state of water management, but not less than once a year.
